Three Paths Forward

ATFI’s investigation has identified three legitimate constitutional paths for addressing representation in the House. Each deserves careful examination before ATFI determines its future direction.

Three Constitutional Paths That Deserve Examination

  1. Continued ratification of Article the First
    If Article the First remains legally pending, additional states could consider ratification. However, because its final language says “nor more than one Representative for every fifty thousand persons,” ratification would not itself compel Congress to enlarge the House beyond 435.   2. Congressional legislation
    Congress could amend or repeal the statutory 435-seat limit and establish a larger House under its existing constitutional authority. LEARN MORE (Coming Soon!)
  3. A new representation amendment through Article V
    A new amendment could be proposed either:
    • By two-thirds of both houses of Congress; or
    • Through a convention called after applications from two-thirds of the state legislatures.
    Either proposal would then need ratification by three-fourths of the states. ATFI’s state-first approach would fall under the second proposal method. LEARN MORE (Coming Soon!)

ATFI has not selected a final path to proper constitutional representation. We will continue examining the constitutional language, historical record, legal questions, and practical consequences of each option. Our findings will be documented on the pages linked above (coming soon).
